Parched Terms of Use
Effective date: 1 November 2026
Last updated: 3 November 2026
Terms version: 2026-11-01
Summary (plain language, not a substitute for these Terms)
- Parched is a general wellness app for tracking how much water you drink. It is not a medical device and doesn't give medical advice. Drinking too much water can be dangerous, so drink to thirst and never force yourself to reach a goal.
- You must be at least 13. If you're under 18, a parent or guardian must agree to these Terms for you.
- Using Parched requires signing in with Apple or Google. Your drinks, groups and Premium belong to that account.
- Be kind in groups. Display names and group names must not be offensive or impersonate anyone. Report a problem from the group's page, or to support@appsbynikki.com, and we review it within 7 days.
- Premium is an auto-renewing subscription billed by Apple or Google. Cancel it in the App Store or Google Play. Deleting the app or your account doesn't cancel it. If Premium ends, the group you own ends for everyone.
- Your rights under consumer law come first. These Terms are governed by Philippine law, but you keep the protection of the law where you live and can bring a claim in your local courts. There is no arbitration clause and no class action waiver.
- This summary is an aid to reading these Terms. If anything here conflicts with the full text below, the full text controls.
1. Who we are, and accepting these Terms
Parched is operated by an individual developer based in the Philippines ("we", "us"), who publishes it through an Apple Developer Program individual account and a Google Play developer account. The developer's legal name is the Seller shown on Parched's App Store page and the name in the developer contact details on Parched's Google Play page. Apps by Nikki (www.appsbynikki.com) is the name of the developer's website. It is not a company. Contact: support@appsbynikki.com.
These Terms of Use are an agreement between you and us. They cover the Parched apps for iPhone and Android, the Parched apps for Apple Watch and Wear OS, Parched's widgets and Parched's pages on our website (together, "Parched").
How you accept. The Sign in screen shows "By continuing you agree to the Terms of use and Privacy policy." You accept these Terms when you continue past it by tapping Continue with Apple or Continue with Google. Our Privacy Policy (https://www.appsbynikki.com/parched/privacy) explains how we handle your information; it isn't a contract you sign. If you don't agree to these Terms, don't use Parched.
Language. These Terms, the Privacy Policy and the Consumer Health Data Privacy Policy are available in English and in Canadian French, in the app and on our website, before you accept. The French versions are at https://www.appsbynikki.com/parched/fr/terms, https://www.appsbynikki.com/parched/fr/privacy and https://www.appsbynikki.com/parched/fr/health-data. If the two versions differ, you may rely on the one more favourable to you.
2. Who can use Parched
- You must be at least 13 years old to use Parched.
- If you're under 18, or under the age of majority where you live, your parent or guardian must agree to these Terms for you and is responsible for your use of Parched. Purchases are made through the App Store or Google Play account holder, under that store's rules.
- Parched is not directed to children under 13.
- You must be allowed to use Parched under the laws that apply to you.
Parched is available in selected countries and regions through Apple's App Store and Google Play. Availability may vary by platform and may change over time. It isn't offered in the European Union, the wider European Economic Area or the United Kingdom.
3. What Parched is
Parched lets you log the water you drink against a daily goal, see your progress and history, set reminders, read short articles in the Hub, use widgets and the Apple Watch and Wear OS apps, and join groups where members see each other's daily progress, nudge each other and play challenges. Premium (section 9) adds a group of your own, your full history and more widget and watch features.
Some features need an internet connection, such as signing in, groups, nudges and purchases. Logging and viewing your own progress work offline and sync when you're back online.
4. Health and safety
Parched is for general wellness. Parched helps you keep track of how much you drink and reminds you to drink. It is not a medical device and does not diagnose, treat, cure or prevent any disease or medical condition. It isn't intended for any medical purpose. Nothing in Parched, including goals, reminders, badges, challenges and Hub articles, is medical advice, and using Parched doesn't create any relationship with a healthcare professional. Settings says so under its About card: "For general wellness. Not medical advice. Talk to a healthcare professional about your own needs."
Your goal is an estimate. The daily goal and the suggestion from the goal calculator are general estimates for healthy adults, worked out from published research that the app shows you ("How it's worked out"). They can't account for your health, your medicines or your circumstances. The goal calculator is designed for adults and accepts ages from 18. If you're under 18, ask a parent or doctor what daily goal suits you.
Talk to a doctor first if you have kidney, heart or liver disease, have been told to limit fluids or salt, take medicines that affect your body's fluid balance (such as diuretics), are pregnant or breastfeeding, exercise hard or for long periods (especially in the heat), or have any other condition where how much you drink matters. Follow your doctor's advice over anything in Parched, and check with a doctor before making decisions about your health.
Too much water can be dangerous. Drinking a lot of water in a short time can lower the level of sodium in your blood (hyponatremia), which can be life-threatening. Drink to thirst and spread your drinks through the day. Never force yourself to drink to reach a goal, keep a streak or win a challenge. If you feel unwell, for example with a headache, nausea, confusion or swelling, stop and get medical help. In an emergency, call your local emergency number.
Reminders aren't guaranteed. Reminders depend on your phone's settings, notification permissions, Focus or Do Not Disturb, battery saving and the operating system, and may arrive late or not at all. Parched schedules them on your phone up to about two days ahead and renews them when you open the app, so they stop if you don't open Parched for a while. Don't rely on Parched for anything where a missed reminder could harm you.
What you log is what Parched shows. Totals, goals met, badges and challenge results come from the drinks you and your devices log. Check that what you log is right.
Apple Health and Health Connect. If you turn on sync, Parched writes the drinks you log to Apple Health or Health Connect, and updates or removes them when you edit or delete a drink in Parched. Parched never reads from them. Those apps are run by Apple and Google under their own terms.
Hub articles are general information, not medical advice (section 10).
5. Your account
Signing in. You sign in to Parched with an Apple or Google account before you can use it. Parched has no passwords and doesn't combine accounts, so sign in with the same option each time. When you first sign in, your display name starts as the first name on that account, and you can change it.
Keeping your account secure. Anyone who can use your Apple or Google account on a phone with Parched can use your Parched account, so keep those accounts and your phone secure. Tell us at support@appsbynikki.com if you think someone else has used your account. You're responsible for what happens in your account, unless it's caused by us or happens through no fault of yours.
Syncing. Parched works offline and saves your changes when you're back online. Drinks logged on a widget or a watch reach your account through your phone, which can take a while. If you sign out while changes haven't synced, they are lost; Parched warns you first when it can tell. A drink logged on a widget or a watch belongs to the account that was signed in on your phone when you logged it, and is never added to another account.
Health information. Parched treats your drinks and your daily goal as health information (Privacy Policy §5). Each drink is saved to your account when you log it. Your daily goal is saved when your account is created, because the app needs it.
6. Groups and community rules
Groups are for encouraging each other. Display names and group names are the only text people type into Parched for others to see. Nudges use fixed messages, and avatars are preset backgrounds behind your initials.
When you use Parched, don't:
- use a display name or group name that is offensive, hateful, harassing, sexual, violent or discriminatory, or that includes anyone's personal information (such as a phone number or address);
- impersonate anyone, including a real person, Parched, Apple or Google, or mislead people about who you are;
- harass, bully, threaten or spam anyone, including by nudging someone who has asked you to stop;
- pressure or encourage anyone to drink more than is safe, including to win a challenge;
- log drinks you didn't have to win a challenge or a badge;
- share an invite code to bring someone into a group in order to harass them, or to get around a removal or block;
- get around a block by creating a new account;
- break the law, or help anyone else break it.
Group owners. If you own a group, you decide who joins, and you can remove or block members. Use these powers fairly and don't use them to harass anyone. A blocked person can't ask to join your group again until you unblock them.
Members. You can leave any group you've joined at any time, and turn off Group alerts in Settings to stop notifications about your groups. Leaving a group stops its members seeing your progress. If you own a group, you can't leave it: remove its members in Manage group, or delete your account, to stop sharing with them.
Reporting a problem. To report an offensive display name or group name, or a member's behaviour, tap Report a problem on the group's page (group owners can also choose Report in a member's menu in Manage group). It opens an email to support@appsbynikki.com with the group's details filled in; tell us who and what happened. A screenshot helps. You can also write to support@appsbynikki.com directly. We review every report within 7 days.
What we can do. If we reasonably believe someone has broken these Terms, we may reset or change a display name or group name, remove someone from a group, end a group, limit features such as nudges, suspend or close an account, or report illegal content to the authorities. Unless the law or someone's safety stops us, we tell the person affected what we did and why, and they can ask us to review it by replying to us.
7. Using Parched properly
You must not:
- copy, scrape or collect information from Parched or about other people by automated means, or use bots or scripts to use Parched;
- reverse engineer, decompile or try to get the source code of Parched, except where the law allows it despite this restriction;
- get around Premium, App Check, rate limits or any security or access control, or interfere with or overload our servers;
- use Parched to break the law, or from a place, or for a purpose, that sanctions or export laws forbid;
- sell, rent or offer Parched to others commercially.
8. Your content
"Your content" means what you add to Parched: your display name, avatar choice, group names you set, and your drinks and goals. It stays yours.
You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your content only to run, secure and support Parched, including showing your name, avatar and progress to the members of groups you're in, as the Privacy Policy describes. The licence ends when your content is deleted, except for:
- the results of a finished challenge, which keep the name and avatar shown at the time as part of that group's history until the group ends (Privacy Policy §11);
- copies in backups, for the periods in the Privacy Policy;
- anything the law requires us to keep.
You confirm that you have the right to use the names you add, and that they don't break these Terms or anyone else's rights. We may remove or change content that breaks these Terms or the law.
9. Premium
What Premium includes. Premium lets you own one group (you and up to five members), see your full history in the All-time tab, and use the widget and watch features marked Premium, such as the log button on widgets and Lock Screen widgets. What's included is shown in the app before you buy. Tracking your water, reminders, the Hub, Apple Health and Health Connect sync, joining other people's groups and your last 30 days of history are free.
Who can buy it. Premium belongs to a Parched account, so you need an Apple or Google account to buy it. It works on any phone signed in to that account.
Price and billing. Premium is an auto-renewing subscription, monthly or yearly, sold through the App Store or Google Play. The price, in your currency, is shown in the app and on the store's purchase screen before you confirm, with any tax the store adds. In the United States the launch prices are USD 2.99 a month and USD 19.99 a year. Payment is charged to your Apple or Google account when you confirm the purchase. There is no free trial.
Renewal. Your subscription renews automatically for the same period at the price then current, until you cancel. To stop the next charge, cancel at least 24 hours before the end of the current period; the store's own rules set the exact cut-off. The store charges your account for the renewal shortly before the new period starts.
Cancelling. Cancel at any time in the store that bills you:
- App Store: Settings → your name → Subscriptions → Parched → Cancel Subscription.
- Google Play: Play Store app → your profile picture → Payments & subscriptions → Subscriptions → Parched → Cancel subscription.
In Parched, Settings → Manage plan → Cancel or change billing opens the store's subscription screen. Or use the store's own subscription settings, as above. Cancelling stops the next renewal, and you keep Premium until the end of the period you've paid for. Deleting the app or your Parched account doesn't cancel your subscription. We can't cancel a subscription for you.
Changing plan. You can switch between monthly and yearly in Settings → Manage plan. The store decides when the switch takes effect; on the App Store a move from yearly to monthly starts at your next renewal.
Refunds. Apple and Google process payments and decide refund requests under their own policies. Ask Apple at https://reportaproblem.apple.com, or Google through your Google Play order history (https://play.google.com/store/account/orderhistory). We never ask a store to refuse a refund. This doesn't limit any right to a refund or other remedy you have under consumer law (section 15). If a refund ends your Premium, the same things happen as when Premium ends.
Price changes. If the price of your subscription changes, the store tells you in advance and asks for your agreement where its rules or the law require. If you don't agree, you can cancel before the new price applies.
When Premium ends. When your Premium ends for any reason (you cancel and the period runs out, a payment fails after the store's grace period, or a refund), the group you own is dissolved for everyone: its members are removed and notified, and its challenges and challenge history are deleted. Your own drinks and history aren't deleted, but the All-time tab and Premium widget and watch features lock until you subscribe again. Members' own drinks aren't affected. If you subscribe again, you get a new group; the old one can't be restored.
Restoring. If Premium doesn't show after reinstalling Parched or on a new phone, sign in to the same Parched account and use Restore purchases in Settings → Manage plan.
10. Hub articles and links
Hub articles are written with the help of AI tools from the published research and public health sources cited in each article, and checked against those sources before they're published. Pictures in articles are generated illustrations, not photographs of real people or events. Articles are general information, not medical advice. They can contain mistakes or become out of date, so check the cited sources and ask a doctor about your own situation.
Articles link to other websites, which open in an in-app browser. We don't control those websites and aren't responsible for them.
11. Other services and trademarks
Parched works with services run by others, including the App Store, Sign in with Apple and Apple Health (Apple), and Google Play, Google Sign-In and Health Connect (Google), as well as the service providers named in our Privacy Policy. Your use of those services is governed by their own terms, and you must follow any third-party terms that apply when you use Parched, such as your mobile data plan.
Apple, Apple Watch, Apple Health, HealthKit and App Store are trademarks of Apple Inc. Google Play, Android, Wear OS and Health Connect are trademarks of Google LLC. Parched isn't made, sponsored or endorsed by Apple or Google.
12. Our intellectual property, and feedback
Parched, its design, code, text and graphics, and the Parched name and logo belong to us or our licensors, to the extent they are protected. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable licence to use Parched for your own non-commercial use, on devices you own or control, under these Terms and the rules of the store you got it from. We keep every right we don't expressly give you. You can't use our name or logo without our permission.
If you send us ideas or suggestions, we may use them without owing you anything. This doesn't limit your right to post honest reviews of Parched anywhere.
13. Changes to Parched and availability
We keep improving Parched and may add, change or remove features. If a change would take away something you've paid for, or reduce what Premium includes, we treat it as a change to these Terms under section 18: you get at least 30 days' notice, and it reaches you only from your next renewal after that notice, so you can cancel before it applies.
We try to keep Parched available, but it may be interrupted for maintenance, updates, outages at our service providers, changes to iOS or Android, or other reasons beyond our control.
If we decide to stop offering Parched, we will tell you in the app at least 30 days beforehand and stop selling new subscriptions when we announce it. If Parched closes before the end of a period you've paid for, ask the store for a refund; if the store doesn't refund you, email support@appsbynikki.com and we will refund the unused part of that period ourselves.
14. Ending your use of Parched
You can stop at any time. Delete your account in Settings → Delete account (Privacy Policy §12 explains what is deleted and what remains). Deleting it removes your profile, drinks and memberships, and ends any group you own (its members are told). It doesn't cancel a store subscription.
We can suspend or close an account if its owner seriously or repeatedly breaks these Terms, if the law requires it, or to protect other people or Parched. Unless it's urgent or the law stops us, we tell you first and give you a chance to put things right. We never close an account for a minor breach. If we close your account for a reason that isn't your breach of these Terms, and the store doesn't refund you, we will refund the unused part of any Premium period you've paid for.
Closing an account, by you or by us, doesn't cancel a store subscription. Cancel it in the store (section 9).
Sections 8, 12, 15, 16, 17, 21 and this section continue after these Terms end.
15. Your consumer rights, disclaimers and limits on liability
Your consumer rights come first. If you are a consumer, nothing in these Terms excludes, restricts or changes any right or remedy that the law where you live gives you and that can't be excluded by contract. In particular:
- Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
- New Zealand. If you use Parched for personal, domestic or household purposes, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 that these Terms don't exclude or limit, whether Parched is treated as goods or as services.
- Canada. Nothing in these Terms excludes or limits a warranty, condition, right or remedy that your province's or territory's consumer protection law gives you and doesn't allow to be excluded, such as the warranty under Ontario's Consumer Protection Act, 2002 that services are of reasonably acceptable quality. If you are a consumer in Québec, see the statement below.
- Singapore. Liability for death or personal injury caused by negligence can't be excluded. Other limits on our liability for negligence or breach of contract apply only so far as they are reasonable under the Unfair Contract Terms Act 1977, and nothing in these Terms limits your rights under the Consumer Protection (Fair Trading) Act 2003.
- Philippines. Nothing in these Terms limits liability for fraud, which can't be waived, or any liability under the Consumer Act of the Philippines that can't be reduced by contract.
- United States. The exclusions and limits below apply only as far as the law of your state allows. If you live in New Jersey: the disclaimer of implied warranties, the exclusion of indirect, incidental, special, consequential and punitive damages, the limit on our total liability in this section, and section 16 apply to you only to the extent New Jersey law permits. If you live in California: under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
To raise a claim under consumer law, email support@appsbynikki.com. You can also ask the store for a refund (section 9).
The rest of this section applies only as far as the law where you live allows.
If you are a consumer in Québec: the next two paragraphs (the "as is" disclaimer and the limits on our liability) don't apply to you, because Québec's Consumer Protection Act doesn't allow them. Your rights under that Act and the Civil Code of Québec apply in full.
Parched is provided "as is" and "as available". We don't make promises about Parched beyond those in these Terms. In particular, we don't promise that it will be uninterrupted or error-free, that reminders or notifications will always arrive, that syncing will always succeed, or that goals, suggestions or Hub articles suit your health needs (section 4). We exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Limits on our liability. We aren't liable for indirect, incidental, special, consequential or punitive damages, for loss of profits, business or opportunity (Parched is for personal use), for loss that wasn't reasonably foreseeable when you accepted these Terms, or for loss caused by your breach of these Terms or by events outside our reasonable control. We aren't liable for the loss of information you didn't sync (section 5). Our total liability for all claims about Parched or these Terms is limited to the greater of (a) what you paid for Premium in the 12 months before the event that gave rise to the claim, and (b) USD 100 (or the equivalent in your local currency).
Other people in your groups. Other people in your groups are responsible for what they do; we aren't liable for their conduct, except where we caused or contributed to the harm or the law says otherwise.
What we never limit. These limits never apply to our fraud, bad faith, gross negligence or wilful misconduct, to death or personal injury caused by our negligence, or to any other liability that can't be limited or excluded under the law that applies to you, including the consumer rights at the start of this section.
16. Responsibility for your own conduct
If someone else brings a claim against us because you intentionally broke section 6 or 7, or because a name you added infringed someone's rights or broke the law, you agree to cover the reasonable costs, losses and damages that claim causes us, to the extent you caused them and as far as the law where you live allows. This never applies to anything caused by our own breach of these Terms, our negligence, a defect in Parched, or your ordinary use of Parched as these Terms allow. We will tell you promptly about any such claim and let you take part in responding to it. This section doesn't apply to you if you're a consumer in Australia, New Zealand or Québec, and doesn't limit any right you have under consumer law (section 15).
17. Governing law and disputes
Talk to us first. If something goes wrong, please email support@appsbynikki.com describing it and what you'd like us to do, and give us 30 days to try to put it right. We aim to reply to complaints within 7 days. This is a request, not a condition: it doesn't stop you contacting a consumer or privacy regulator at any time, and it doesn't shorten any deadline for your claim.
Governing law. These Terms are governed by the laws of the Republic of the Philippines, where the developer of Parched is based, without regard to conflict-of-law rules. This doesn't take away the protection of any law of the country, state or province where you live that can't be excluded by contract: if that law gives you a right that Philippine law doesn't, or says a term of these Terms doesn't apply to you, you keep that right and that term doesn't apply to you.
Where to bring a claim. You can bring a claim against us in the courts of the Philippines, or in the courts of the place where you live, including small-claims courts and tribunals such as New Zealand's Disputes Tribunal and Singapore's Small Claims Tribunals. If we bring a claim against you, we will bring it only in the courts of the place where you live. If you are a consumer in Québec, you can bring a claim before the Québec courts, and Québec's mandatory protections apply to you whatever these Terms say about governing law.
No arbitration, no class action waiver. Nothing in these Terms requires you to use arbitration, or stops you from bringing or joining a class action, or from complaining to a regulator (for example the Federal Trade Commission or your state attorney general in the United States, the ACCC or your state or territory consumer agency in Australia, or the Commerce Commission in New Zealand).
18. Changes to these Terms
We may change these Terms when we change Parched, when the law changes, or for another good reason. We won't use this section to change the price of a subscription you already have (price changes go through the store, section 9), what kind of service Parched is, or how long your subscription lasts.
Material changes. At least 30 days before a material change takes effect, we tell you in the app or by email, setting out the new wording and the wording it replaces, the date it takes effect, why we're making it, and your right to refuse it. You can refuse a change by deleting your account, and by cancelling Premium, at no cost. A change that increases what you pay or reduces what we provide applies to an existing subscription only from your next renewal after that notice. If such a change still reaches you before you could cancel, you can refuse it and cancel at no cost, up to 30 days after it takes effect: ask the store for a refund, and if the store doesn't refund you, email support@appsbynikki.com and we will refund the unused part of the period ourselves.
Other changes. Changes that aren't material, such as clearer wording or a new contact detail, take effect when we post them, with a new "Last updated" date.
If you keep using Parched after a change takes effect, the changed Terms apply to you, subject to your rights in this section.
19. If you got Parched from the App Store
These terms apply to your use of Parched on Apple devices, in addition to the rest of these Terms. If they conflict with the rest of these Terms, this section controls for Apple devices.
- Acknowledgement. These Terms are between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for Parched and its content.
- Scope of licence. Your licence to use Parched is a non-transferable licence to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for providing any maintenance and support for Parched, as set out in these Terms or as required by law. Apple has no obligation whatsoever to provide any maintenance and support services for Parched.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed. If Parched fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Parched to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Parched, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to Parched or your possession and use of it, including (i) product liability claims; (ii) any claim that Parched fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with Parched's use of HealthKit. These Terms don't limit our liability to you beyond what the law allows.
- Intellectual property rights. If a third party claims that Parched, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You confirm that (i) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and (ii) you are not listed on any US Government list of prohibited or restricted parties.
- Developer name and address. Parched is provided by the developer described in section 1, whose legal name is the Seller shown on Parched's App Store page, and the Seller information shown there applies. Questions, complaints and claims about Parched: support@appsbynikki.com. We provide support by email; our postal address and a telephone number are provided on request to support@appsbynikki.com.
- Third-party terms. You must comply with any applicable third-party terms when using Parched, such as your wireless data service agreement.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
Apple's standard licence. If Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) is shown as the licence agreement on Parched's App Store page, it also applies to your licence of the app. If it conflicts with these Terms, it controls only for the licence to the app software and Apple's own rights, and these Terms control for everything else. Where both limit our liability, the limit more favourable to you applies.
20. If you got Parched from Google Play
Google Play's Terms of Service also apply to your use of Google Play. Google isn't a party to these Terms and isn't responsible for Parched; we are. Purchases through Google Play are also governed by Google Play's own terms and refund policies.
21. General
- Whole agreement. These Terms, together with the terms shown when you buy Premium, are the whole agreement between you and us about Parched. This doesn't limit liability for fraudulent misrepresentation or your rights under consumer law.
- Severability. If a court finds part of these Terms unenforceable, that part is enforced as far as the law allows and the rest stays in effect.
- No waiver. If we don't enforce a term straight away, we haven't given up the right to enforce it later.
- Transfer. You can't transfer these Terms to someone else. We may transfer them to someone who takes over running Parched, if they agree to honour these Terms and the Privacy Policy and your rights aren't reduced; we will tell you in the app first.
- Events outside our control. We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages at Apple, Google or our service providers, natural disasters, or changes to an operating system that stop a feature working. We will try to limit the effect. This doesn't affect any refund the law gives you for a paid period we couldn't provide.
- Notices. We give notices in the app, by email where your account has an email address, or on our website. Send notices to us at support@appsbynikki.com.
- Third-party rights. Apart from Apple (section 19), no one else has rights under these Terms.
- Interpretation. "Including" means "including without limitation". Headings are for convenience only.
22. Contact
Questions about these Terms, reports, complaints and consumer law claims: support@appsbynikki.com. We aim to reply within 7 days, in English or French.
